I hit a someone that needs to modify their visa to be with a displeased female and they were wondering if they crapper modify the 90 period visa by feat to canada and reaching backwards into the US? There is a unification on the govn’t website that does not impact where this aggregation should be found.

    There are not too many circumstances that would disallow you re-entry to the US. However, be aware that one of the things that will stop you at the border and cause you to be turned back is if you overstayed your Visa in the first place. This would not necessarily keep you from re-entering, but it could.

    If you stayed till the end of your Visa, went to Canada for a weekend and then expect to come back to the US, this could also keep you out of the US specifically because border control may suspect that you are trying to live in the US illegally; i.e., stay till the end of the Visa, travel away for a week and then come back on another 90-day stay.

    The best thing to do is to get a hardship Visa. A letter from the family physician stating the medical need for family will help your re-entry efforts emmensely.

    It appears a trip to Canada (or Mexico/adjacent islands) does not qualify as “leaving the USA” for the purposes of the Visa Waiver Program.

    According to the Q&A section of : “http://usembassy-australia.state.gov/consular/visawaiver.html

    “Is there a limit to how many times I can enter the U.S. on the VWP? Must there be a minimum period between one period of travel on the VWP and the next?
    No, but entry or re-entry into the United States is at the discretion of immigration officials at the port of entry.”

    “If I travel to Canada or Mexico, can I re-enter the U.S on the VWP, and if so does the 90 days then start again?
    VWP travelers who have been admitted to the U.S. under the Visa Waiver Program and who make a short trip to Canada, Mexico or an adjacent island generally can be readmitted to the U.S. under the VWP for the original admission period. They do not, however, get a new 90 day admission period.”

    The website also says that 90 day stay cannot be extended or converted. However, there are apparenty exceptions for medical treatment, and that should include treatment for a dependant child.
